Any Personal Information provided to or gathered by LogBox ("Data") is controlled by LogBox
(Pty) Ltd, Registration Number: 2007/030227/07, whose registered address is at 46 Ingersol
Road, Lynnwood Glen, Pretoria, Gauteng, 0081.
- Interpretation and Definitions:
- Throughout this Privacy Policy the terms "LogBox", "we", "our" and/or "us"
shall refer to LogBox (Pty) Ltd, Registration Number: 2007/030227/07. In this Privacy Policy the terms "you" and/or
"your" shall refer to the Data Subject.
- Words that are defined in the Protection of Personal Information Act No.4 of 2013 ("POPIA")
and/or in the User Agreement (the terms and conditions of use of the App as displayed on
the LogBox App and/or Website from time to time) but are not defined in this Privacy Policy
will bear the same meaning as in POPIA and/or the User Agreement. For ease of reference,
such terms have been capitalised in this Privacy Policy.
- Introduction:
- Logbox is aware that you exercise care when it comes to who has access to your Personal
Information and that you are concerned as to how, your Personal Information is used and
shared. We value the Personal Information that you choose to provide and will take
appropriate steps to protect your Personal Information from loss, misuse or unauthorised alteration.
Your Personal Information is stored in databases that have built-in safeguards to ensure the privacy
and confidentiality of that information.
- The above being said, this Privacy Policy describes inter alia the categories of Personal
Information that LogBox may collect, record, and/or stall which we obtain from you and/or
your doctor/medical practice, the purposes for which we may use your Personal Information,
the circumstances in which we may share your Personal Information as well as the protective
measures that we have taken to safeguard your Personal Information and with that your privacy.

What is Data Subject?
You and any/all of your dependents are Data Subjects. When we say we share your Data with
other Data Subjects, such sharing is limited to only medical practitioners and/or their practices.

What and Who Is A Responsible Party?
LogBox is a responsible party and determines the means and purpose for which your Data is to be processed.

What Is Your Personal Information (Your "Data")?
Your Personal Information includes but is not limited to any information by which you can be
identified, such as your name and contact information, demographics, gender, sex, origin, colour,
sexual orientation, marital status, age, language, identity number, passport number, date of birth,
preferred communication methods, bank details and credit card details and biometric information etc.

What Is Special Personal Information (Your "Data")?
Includes your Personal Information concerning your religious or philosophical beliefs, race or
ethnic origin, trade union membership, political opinions, health, DNA, sexual life or criminal behaviour.
- When And How Will We Process The Personal Information Of Children?

A child is a person defined as such by a country’s legislation, and who has not been
recognised as an adult by the courts. In South Africa, the Bill of Rights and the Children's
Act define a child as a person under the age of 18 years.

We will only process the personal information of children if the following applies:

the law permits it; and
-
a person with the ability to sign legal agreements has consented to such processing, being the parent or guardian of the child. This consent will typically be supplied by adding the child as a dependent to your LogBox profile;

The personal information of children is processed in the same way as your Data and the same security measures and checks apply.
- What Data Do We Collect From and/or About You?

If you are a patient ("Patient User"):
- Your name and identity number, e-mail and physical addresses, postal address,
contact information, information from your contact list, information relating to your race, gender, ethnic or social origin,
age, employment details, dependants’ details, referring doctor’s details,
medical and medical aid details, views or preferences and the pages of the App viewed by you.

If you are a medical doctor/practice ("Practice User"):

Your name and identity number, e-mail and physical addresses, postal address,
contact information, information from your contact list, information relating to your race, gender, ethnic or social origin,
age, details relating to your medical practice, and your registration details at the HPCSA,
views or preferences and the pages of the App viewed by you.

By providing your Data to us, you are consenting to us using it as provided for in our Privacy Policy.

How Do We Protect Your Data?
- Logbox will take all appropriate and reasonable technical and organisational steps to prevent,
as far as possible, and to the best of LogBox's capabilities, any unauthorised access to, or disclosure
of your Data. No method of transmission over the internet or electronic storage is 100% secure, as a
result, we cannot guarantee absolute security.

We maintain physical, electronic and procedural safeguards in connection with the collection, storage
and disclosure of Data. Our security procedures mean that we may occasionally request proof of identity
before we disclose Data to you or to any other person permitted to receive your Data in terms of law.

Where there are reasonable grounds to believe that your Data has been accessed or acquired by any
unauthorised person, Logbox will as soon as possible after becoming aware of such unauthorised access,
notify you and the Information Regulator which is appointed in terms of POPIA. Logbox will delay notifying
you of the unauthorised access or acquisition of your Data if a public body responsible for detection,
prevention or investigation of offences or the Information Regulator informs us that notifying you will
impede a criminal investigation. When Logbox notifies you of the compromise to the security of your Data,
Logbox will provide you with sufficient information to allow you to take protective measures against the
potential consequences of the compromise.
- Logbox recognises the importance of protecting your privacy in respect of your Data collected by
Logbox when you use the App.

What Does Processing Of Your Data Mean?

Processing means any operation or activity or any set of operations, whether or not by automatic means, concerning your Data, including—
- the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval,
alteration, consultation, use, dissemination by means of transmission, distribution or making available in
any other form; or merging, linking, as well as restriction, degradation, erasure or destruction thereof by LogBox.

How Do We Process Your Data?
- We use your Data to provide the Services you request from LogBox such as to facilitate start administration,
administration of your membership, facilitate bookings and/or appointments with your doctor/practice and other transactions.
- We also collect, receive and store your Data on the App and share your Data with your doctor/practice if you
consent thereto by scanning the QR code at the reception of your doctor/practice.
- We may also use the Data to do demographic research, advertise products and services, process payments
and maintain accounts and records, to prevent crime and aid in the prosecution of offenders and to
administer and maintain patient and/or medical doctor/practice records.
- We use this Data to proof our App and customer services platform, detect and prevent fraud or abusers
of our App and enable third parties to carry out technical, logistically or other functions on our behalf.
- We also use the Data in the course of collecting fees and any other payments that may be due to us from you.
- Other than set out in this Privacy Policy, we shall not share your Data with third parties for marketing
or any other purposes, without your consent, unless we acquired to do so by law.
- We operate an automatic opt-in policy which means when you request information from us or make an
enquiry, your Data is saved on our database.
- LogBox may collect your Data:
- directly from you once you download the App and register your profile; or
- indirectly from your doctor/medical practitioner and/or practice once they upload your
Data on the App, with your consent.
- LogBox may use your Data:
- as a Patient User, to notify and authenticate your identity when you view and access your Profile;
- as a Practice User, to check that you are duly registered with the HPCSA;
- to verify your identity on the App;
- for security, administrative and legal purposes;
- for customer relations; and
- for helping us in any future dealings with you.
- LogBox may share your Data:
- LogBox will not disclose any of your Data to third parties, except when LogBox has your
consent/permission to do so or where LogBox is required to do so in terms of law, or where such
sharing would be in your best interest.
- You agree that your de-identified aggregate Data may be shared under the following circumstances:
- to our holding companies, subsidiary companies, agents, advisers, service providers and suppliers;
- to monitor web traffic: our servers serving the App automatically collect information about pages
you visit. This information is used for internal review, to tailor information to individual visitors
and for traffic audits. This information (as well as information from third-party market researchers),
on an aggregated, anonymous basis, is provided to Advertisers advertising on the App. Should you provide
Data online as part of an online advertising promotion or in order to access a third party service,
such information may be provided directly to the Advertiser or the third party concerned;
- promotions: many promotions offer opportunities to request additional information from sponsors
or third parties. When you request more information about a particular promotion, your e-mail
address may be shared with the sponsor of that promotion; and/or
- for statistics and advertisement purposes: LogBox may perform statistical analyses in order to
measure interest in the various areas of the App (for product development purposes) and to inform
Advertisers as to how many consumers have seen or "clicked" on their advertising banners.
LogBox may also use aggregated demographic Data to allow advertising banners on the App to be targeted,
in aggregate; or
- government and law enforcement agencies: where the law requires that LogBox disclose your Data
to a party, and where LogBox have reason to believe that a disclosure of Data is necessary to
identify, contact or bring legal action against a party who may be in breach of the App Terms
or may be causing injury to or interference with (either intentionally or unintentionally) our
rights or property, other users, or anyone else that could be harmed by such activities.
- LogBox will limit the types of Data Processed to only that which you have given your Consent and
which is necessary for our legitimate business interests or as is required by law.

When and Under What Circumstances Will We Process Your Data?
- LogBox may only process your Data under the following circumstances:
- If you are registered on the App, you have consented to us processing your Data and all
processing shall take place in accordance with the terms and conditions set out in the User Agreement
and this Privacy Policy.

Can We Process Your Data Without Your Consent?
- Yes, however we will only process your Data without your consent in the following circumstances:
- If the processing is authorised by law;
- If the processing is in your best interests (for example in the case of an emergency where
it would be impractical and/or impossible for us to first obtain your Consent, whether in
relation to you or any of your dependents); and/or
- If the processing is necessary for our legitimate interests, the legitimate interests of
the doctors/practices to whom Data is supplied or required in terms of the law.

What Is Consent and What Do You Consent To?
- Consent within the context of this Privacy Policy means that you permit, allow and/or authorise LogBox
to process your Data once you register your profile on our App.
- Consent within the context of this Privacy Policy, does not in any way mean “Informed Consent” to
receive medical treatment, as is defined in the National Health Act No. 61 of 2003.

Can You Withdraw Your Consent And How?
You can withdraw your Consent and request to have your data removed at any time by either:

giving us written notice via the App by following the steps indicated on the App.

What Do We Do With Your Data After You Have Withdrawn Your Consent?
- We shall safely return the Data to you and securely dispose of the Data from our App, unless we are
authorised and obliged to retain your Data for the required purpose for which we have collected it, or
as long as the law may require.
- Once we need to dispose of your Data we will notify you, in writing, where after your Data will
be securely disposed of after 30 (Thirty) days from the date of such notice being sent to you, unless
you notify us otherwise.

For How Long Do We Retain Your Data?
- We will retain personal information for the period necessary to fulfil the purposes outlined in
this Privacy Policy unless a longer retention period is required or permitted by other applicable law.

We will keep your personal information for as long as:

the law requires us to keep it;

an agreement between youself and LogBox requires us to keep it;

you have consented to us keeping it;

we are required to keep it to achieve the purposes listed in this Privacy Policy;

we require it for statistical or research purposes, in which case your Data will be deidentified;

we require it for our lawful business purpose; and
-
we are required to keep it as per the appropriate medical laws and acts.

Note that we may keep your Data even if you no longer have a relationship with us, if the law permits.

What You Agree To When You Download And Register Your Profile On The App:
- You agree to the terms set out in this Privacy Policy. If you do not agree with this Privacy Policy,
please do not continue to use the App and/or the Services; and
- You agree that LogBox may Process your Data for, amongst other things, the following purposes:
- for providing you with access to the App and all of its Services; and/or
- for any and all of the purposes listed in clause 12.

What Are Your Rights:
You have the option of correcting, updating, deleting, changing and/or objecting to the processing of
any of your Personal Information been stored and/or provided on our database, subject to the provisions
of POPIA and any other applicable data protection laws. If you wish to correct, update, delete and/or
change your Personal Information, you can simply update your Personal Information on the App by following
the instructions on the App.

Can We Transfer Your Data Internationally (Cross Border):
Yes, but we are obligated to ensure that the receiving location has similar data protection policies and measures in place as per POPIA.

What Are Cookies and Do We Use Cookies?

Cookies are pieces of information an App transfers to a user's hard drive for record-keeping purposes.
Cookies make surfing the web easier for you by saving your preferences and, tracking your online habits,
traffic patterns, and making sure that you do not see the same advertisement too often.
The use of cookies is an industry standard.

LogBox may place a "cookie" on your browser to store and sometimes track information about you.

While most browsers are initially set up to accept cookies, you can reset the Data Subject’s
browser to refuse all cookies or indicate when a cookie is being sent. Please note that some parts
of the App will not function properly if you refuse cookies.

What About Links to Other Websites, Apps or Other Pages
Our App may include links to other websites, Apps or other pages. We do not provide any Data to these
advertisers or third party websites, Apps or other pages. These third party websites, Apps or other
pages may use technology to send or (“serve”) the advertisements that appear on our App. They automatically
receive your IP address when this happens. They may also use cookies, JavaScript, web beacons (also known
as action tags or single-pixel gifs), and other technologies to measure the effectiveness of their ads and
to personalise advertising content. We do not have access to or control over cookies or other features that
they may use, and the information practices of these advertisers and third party websites are not covered by
this Privacy Policy. Please contact them directly for more information about their privacy practices.

Use of IP Address:
- An IP address is a number that is automatically assigned to a computer whenever it is connected to the
Internet. LogBox log IP addresses, or the location of computers on the Internet.
- LogBox collects IP addresses for the purposes of system administration and to audit the use of the
App. LogBox does not ordinarily link IP addresses to Data, which means that your session may remain
anonymous. However, LogBox cannot guarantee that this will always be the case, as it may be necessary
to identify a particular user when it is necessary to enforce compliance with the App Terms or to protect
our App, its users or other interests.

Passwords and Login Information:
- You may register your Data with LogBox via the App.
- If you register your Data, LogBox will provide you with a username and password.
- You must not provide your username or password to anyone. You are solely responsible for keeping
your username and/or password secret.
- You are solely responsible for any loss you may suffer should any other person gain access and/or use
your username and/or password.

Amendments to The Privacy Policy:
LogBox reserves the right to vary the terms of this Privacy Policy. It is your responsibility to
familiarise yourself with the most recent version of this Privacy Policy each time you access the App.
